Terms of Service

1. Provider

These Terms govern your use of myopenai (myopenai.site, the “Service”), provided by Nubri GmbH, Liebenowzeile 22, 12167 Berlin, Germany, registered at Amtsgericht Charlottenburg under HRB 217794 B (“we”, “us”). Contact: info@nubri.co.

2. The Service

The Service is an API gateway with an OpenAI-compatible interface. It forwards your requests to third-party AI models, such as Anthropic’s Claude models served through Amazon Bedrock, and returns their responses. It charges usage against prepaid credit and lets you set spending caps per API key. The models currently offered and their prices are listed on the website and returned by the API.

3. Accounts and API keys

  • You must be at least 18 years old and provide a valid email address.
  • Keep your password and API keys confidential. You are responsible for all usage made with your API keys. If a key may be compromised, revoke it in the dashboard immediately; usage made before revocation is charged.
  • Accounts are personal and may not be shared, sold or transferred.

4. Prepaid credit and prices

  • Credit is bought in US dollars in advance through our payment processor, Stripe. Credit is added to your wallet once the payment is confirmed.
  • Each request is charged at the price per million tokens shown for the model when the request is made, based on the token counts reported by the model provider. Before a request is forwarded, an upper bound of its cost is held from your credit; only the actual charge is deducted and the rest is released afterwards. If a streamed response is interrupted before the provider reports usage, the held amount is charged. How holds work is described in the documentation.
  • Credit does not expire. It has no cash value, cannot be transferred and can only be used for the Service.
  • We may change prices for future requests. Changes never apply to requests already made. Prices on the website are updated before a change takes effect.

5. Refunds

You can request a refund of the unused part of a credit purchase within 14 days of that purchase by emailing info@nubri.co from your account’s email address. Refunds are made to the original payment method. Beyond that period, credit is not refundable, except where required by law or where we end the Service or your account without cause (section 9). Statutory consumer rights remain unaffected.

6. Spend caps

Spend caps are enforced as described in the documentation: a request whose hold could exceed a key’s remaining cap is refused before it is forwarded. Caps limit charges to your credit; they do not limit your responsibility for how you use the Service.

7. Acceptable use

You must not use the Service to:

  • break the law or infringe the rights of others;
  • violate the usage policies of the model providers, including Anthropic’s Usage Policy and the AWS Responsible AI Policy;
  • generate content that sexualises minors, facilitates serious harm, or is used for fraud, spam or malware;
  • circumvent rate limits, spend caps or other technical controls, or probe, scan or overload our systems;
  • resell or give third parties access to the Service without our written permission.

8. AI output and availability

Responses are generated by third-party models. They can be inaccurate, incomplete or unsuitable, and you are responsible for reviewing them before relying on them. We aim for high availability but do not guarantee uninterrupted service; upstream providers may be unavailable, rate limited or change their models. We may add or retire models; where reasonably possible we announce retirements in advance.

9. Suspension and termination

You may stop using the Service at any time and ask us to delete your account. We may suspend or close an account that breaches these Terms, is used fraudulently, or whose payments are charged back. If we close your account or end the Service without such a reason, we refund your unused credit.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible and on which you may rely), limited to the damage typical and foreseeable at the time the contract was concluded. Otherwise our liability is excluded.

How we process personal data is described in the Privacy Policy.

12. Changes to these Terms

We will notify you of changes to these Terms by email at least 30 days before they take effect. If you do not agree, you can close your account before that date and receive a refund of your unused credit.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of your country of habitual residence remain unaffected. If you are a merchant, the exclusive place of jurisdiction is Berlin, Germany.
